The TUC are leading a campaign called Dying to work. You may not realise it that while the 2010 Equalities Act offers some protection for employees who are terminally ill it still allows employers to dismiss someone if they fail a capability assessment despite reasonable adjustments.
The dying to work campaign would like terminal illness to be a protected characteristic so individuals have a period of protection where they cannot be dismissed as a result of their condition.
The campaign aims to
- get terminally ill workers covered by Protective Rights at Work in line with those covered by Pregnancy/Maternity Rights
- protect death in service benefits
- allow workers with terminal illness to die in dignity
